Transfer of personal data under GDPR to third countries (Checklist)

The GDPR will  certainly simplify the transfer of data within the EU by establishing  uniform minimum protection requirements. BUT, more important, questions are relevant (ie for the controllers  to  be resolved) for data transfers to third countries, and the option they may have to comply with GDPR.

Checklist for the transfer of personal data to third parties  (examination level 1):

  1. Application of the GDPR?
  2. Transfer of personal data to a third party

Consent available?
Legal fact of permission?
Other permission available( such as eg works’ agreeent)?

Checklist for the specific requirements for the transfer of personal data to third countries (examination level 2):

  1. Is there a decision of appropriateness?
  2. EU Standard clauses signed?
  3. BCR (Binding Corporate Rules)?
  4. CoC (Code of Conduct)?
  5. Certified data importer?
  6. Consent of ALL persons concerned?
  7. Transfer in order to complete an agreement?
  8. Transfer to preserve public interest?
  9. Transfer to enforce legal claim(s)?
  10. Transfer to preserve vital interests?
  11. Transfer from a public registry?
  12. Transfer to preserve legitimate interests?

Simple questions with complex answers (maybe); an essential exercise to  be prepared for.
